Auction Terms & Conditions
1. Inspection & Guarantee
If, during this period, the buyer decides the item does not meet expectations, the buyer may return it within five (5) days of delivery for a full refund of the purchase price. All returned units must remain in substantially the same condition as delivered.
2. Equipment Condition
Every unit is described accurately and in good faith. All machines are sold ready to work, fully inspected, serviced, and backed by a 6-month / 1,500-hour full warranty covering parts and labor. This warranty applies nationwide and may be honored at any authorized dealer or service center for the respective brand.
3. Buyer Responsibility
It remains the buyer’s responsibility to review all photos, videos, and specifications before bidding or purchasing. Questions about a machine’s condition, age, or history should be addressed prior to bidding. Auction Delta LLC endeavors to provide complete and transparent information for every lot but cannot guarantee perfection in descriptions.
4. Payment Terms
All purchases must be settled by bank wire transfer only.
Payment must be completed within 48 business hours of the auction’s end or sale confirmation. No checks, money orders, credit cards, or other forms of payment are accepted. Bank-transfer information is provided on the invoice issued to the winning bidder. All payments must be made directly to Auction Delta LLC’s trust account as stated on the invoice.
5. Buyer’s Premium & Fees
There are no buyer’s premiums, no processing fees, and no hidden charges.
The only additional cost is shipping, calculated at a flat rate of $1.00 per mile from our facility to your delivery address.
6. Shipping & Delivery
Auction Delta LLC provides fully insured nationwide delivery using our dedicated carrier network. Each shipment includes real-time tracking and coverage up to $2 million. Delivery times typically range from 4 to 13 days, depending on location and carrier availability.
Auction Delta LLC takes full responsibility for shipping, logistics, and load-out coordination for all sold equipment. Our experienced team and insured carriers handle every step of the process — from secure loading to delivery at your location.
All equipment is transported by licensed and certified drivers who comply with all state and federal transport regulations. We ensure every load is properly secured, permitted, and protected under up to $2 million in cargo insurance coverage.
Buyers are not required to arrange their own transportation unless they specifically choose to do so. In such cases, buyers must ensure that their drivers are fully qualified and that the equipment is safely and legally transported.
Auction Delta LLC provides professional load-out assistance and assumes responsibility for the safety and care of each unit during handling and transport.
7. Titles & Documentation
A $95 processing fee applies to any titled vehicle or trailer. Titles are transferred only after full payment has cleared. Titles are mailed within approximately 10 business days of settlement. Buyers purchasing through a business entity must provide a copy of the business license or resale certificate before title processing.
8. Risk of Loss
Risk passes to the buyer upon confirmed delivery. Auction Delta LLC maintains transit insurance until the unit reaches its destination.
9. Warranty Coverage
Every machine sold by Auction Delta LLC includes a 6-month / 1,500-hour warranty that covers major components—engine, transmission, hydraulic system, and driveline—against mechanical failure under normal use. Routine wear items and misuse are excluded. Claims may be processed through any authorized dealer or directly through Auction Delta LLC’s warranty department.
10. Safety Notice
All bidders and visitors who attend a live auction or pickup site do so at their own risk. Heavy machinery is in operation; safety protocols must be observed at all times.
11. Final Note
Auction Delta LLC strives to make every transaction fair, transparent, and worry-free. Our inspection period, full refund option, and comprehensive warranty provide unmatched protection for every buyer.
12. Buyer Representations
As Buyer, you represent and warrant that:
(a) All Bidder Information you provide is accurate and free from malicious code or programs;
(b) You are eligible to use Auction Delta Services under this Agreement.
13. Auction Data
Auction Delta owns all rights, title, and interest in all Auction Data, including all related intellectual property. You agree not to record, reproduce, or rebroadcast any Auction Data.
14. Auction Delta Software
Auction Delta owns all intellectual property rights in its software. You gain no ownership through use. You may not decompile, reverse-engineer, or modify any Auction Delta Software except as permitted by law.
15. No Agency
This Agreement does not create any agency, partnership, joint venture, employer-employee, or franchise relationship between you and Auction Delta.
16. Notices
Unless otherwise stated, notices will be sent by email to the address provided during registration. Notices are deemed delivered 24 hours after being sent unless the sender receives a delivery failure notice.
17. Governing Law
This Agreement is governed by and construed under the laws of the State of Montana and the United States of America. All claims under this Agreement must be brought before a court of competent jurisdiction in the State of Montana.
18. Assignment
You may not assign or transfer this Agreement or any of your rights and obligations hereunder without prior written consent from Auction Delta.
